Welcome to the General Terms and Conditions of Bollin Consulting GmbH. Here you will find all important information regarding our contractual terms, order processes, and your rights as a customer. Please read these terms carefully.

§1 Scope and Definitions

(1) These General Terms and Conditions apply to all contracts concluded via our online shop between us and either consumers or business customers.

(2) A consumer within the meaning of these Terms and Conditions is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession (§ 13 German Civil Code – BGB).

(3) A business customer within the meaning of these Terms and Conditions is any natural or legal person, or a legally responsible partnership, who, when entering into a legal transaction, acts in the exercise of their trade, business, or profession (§ 14 German Civil Code – BGB).

§2 Conclusion of Contract, Storage of Contract Text

(1) The following provisions regarding the conclusion of a contract apply to orders placed via our website http://www.bos-akademie.de.

(3) The presentation of goods in our online shop does not constitute a legally binding contractual offer on our part but is merely a non-binding invitation for the customer to place an order. By ordering the desired goods, the customer makes a binding offer to conclude a purchase contract.
(4) When an order is received via our online shop, the following provisions apply: The customer makes a binding contractual offer by successfully completing the order process provided in our online shop.

The order is placed in the following steps:

1) Selection of the desired product
2) Adding the desired quantity to the shopping cart
3) Confirming the cart by clicking the “Proceed to checkout” button 
4) Completing the required fields for determining the shipping and billing address
(Country, First name, Last name, Address, Postal code, City)
5) Selection of the preferred payment option (Advance payment, Invoice)
6) Reviewing and, if necessary, correcting the entered data
7) Final submission of the order by clicking the “Buy now” button. Before bindingly submitting the order, the customer can return to the page on which their details were entered by using the “Back” function of their Internet browser, in order to correct input errors, or cancel the order process by closing the browser window. We confirm receipt of the order immediately by sending an automatically generated email (“Order Confirmation”). This confirmation constitutes acceptance of your offer.

(5) Storage of the contract text for orders placed via our online shop: We store the contract text and will send you the order details and our Terms and Conditions by email. You can view your past orders in your customer account under My Account → My Orders.

§3 Prices, Shipping Costs, Payment, Due Date

(1) All prices include statutory VAT and other price components. Additional shipping costs may apply.

(2) Payment methods:

Advance payment: The customer transfers the invoice amount in advance.

invoice (only for registered returning customers): This option becomes available after the first order and the creation of a customer account.

installment payment (only by individual agreement): Payment in installments can be arranged upon request. There is no legal entitlement to this option.

(3) Payment deadlines:

Advance payment: Due immediately after conclusion of the contract.

invoice: Due within 14 days after receipt of the goods.

§4 Delivery

(1) Unless otherwise clearly stated in the product description, all items offered by us are ready for shipment immediately. Delivery shall take place no later than within 20 business days. The delivery period begins, in the case of advance payment, on the day after the payment order is issued to the transferring bank, and for all other payment methods, on the day following the conclusion of the contract. If the delivery deadline falls on a Saturday, Sunday, or public holiday at the place of delivery, the period ends on the next business day.

(2) The risk of accidental loss or accidental deterioration of the goods sold shall not pass to the buyer until the goods are handed over – even in the case of a mail order purchase. 

§5 Retention of Title

We retain ownership of the goods until the purchase price has been paid in full.
This also applies in the case of installment payments: ownership is transferred to the buyer only after receipt of the final installment.

§7 Warranty

The statutory warranty regulations apply.

§8 Contract Language

The contract language is exclusively German.

§9 Dispute Resolution / Online Dispute Resolution (ODR)

(2) We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
